1. The Service
The Ember List aggregates publicly listed events and sends a personalized digest. Event details (dates, prices, availability, locations) are gathered from third-party sources and may be incomplete, out of date, or wrong. Always confirm details with the official event organizer before making plans. We are not the organizer of, and are not responsible for, any listed event.
2. Your account
You may sign in with Google or an email magic link. You’re responsible for activity under your account and for keeping access to your email secure. Provide accurate information and don’t impersonate others. You must be at least 13 years old (and old enough to form a binding contract where you live) to create an account.
3. Acceptable use
Don’t: (a) scrape, crawl, or bulk-extract the Service or its listings; (b) attempt to break, overload, or gain unauthorized access to the Service; (c) use the Service unlawfully or to infringe others’ rights; or (d) resell or redistribute the digest or listings without our permission.
4. Intellectual property
The Service, its design, and its compilation of listings are owned by us or our licensors. Underlying event information belongs to the respective organizers and sources. We grant you a personal, non-commercial, revocable license to use the Service. If you send us feedback, ratings, or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.
5. Third-party links
The Service links to third-party event pages and sites we don’t control. We’re not responsible for their content, availability, or practices.
6. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, and non-infringement. We don’t warrant that listings are accurate or that the Service will be uninterrupted or error-free.
7. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or missed events, arising from your use of the Service. Our total liability for any claim will not exceed USD $100.
8. Termination
We may suspend or terminate access at any time, including for violation of these Terms. You may stop using the Service and request account deletion at any time.
9. Changes
We may update these Terms; material changes will be reflected here with a new “Last updated” date, and for material changes we’ll note the update in the digest email or on the site. Continued use after changes means you accept them.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Santa Clara County, California.
